Mirena Lawsuit Attorneys Offer Legal Counsel to Patients

There are many options for birth control for women. Depending on one’s body and needs, however, certain methods may work better than others. While many women choose to take birth control pills as a means of preventing pregnancy, this method may not be desirable for some people due to forgetfulness or busy schedules. In these instances, many women turn to a different birth control method: an intrauterine device (IUD) that provides birth control protection for years at a time without the hassle of remembering to take a pill.

In particular, the Mirena IUD has been a popular choice for women seeking long-term birth control. The device is inserted into the patient’s uterus, and the hormone progestin helps to create thicker cervical mucus, thus preventing sperm from fertilizing the egg.

History of Mirena IUDs

The first IUDs, made from copper, were introduced in the 1960s and 1970s. However, only a few years later, these IUDs came fully equipped with hormones to help better protect women from unplanned or unwanted pregnancies. While doctors were creating several models simultaneously, it was Jouri Valter Tapani Luukkainen who first introduced the Mirena IUD and made it available to the public in 1990. The Mirena IUD released levonorgestrel into the patient’s body and quickly became popular among women. Doctors also fitted patients with the device—which could be kept in place for up to five years—if they were suffering from heavy menstrual bleeding after they gave birth.

Side Effects of Mirena

While the IUD has been proven to be an effective birth control method, many doctors, medical professionals and health organizations have found that the Mirena can cause serious conditions in patients. Some complications include:

  • Amenorrhea
  • Ecotopic pregnancy
  • Intrauterine pregnancy
  • Ovarian cysts
  • Pelvic inflammatory disease
  • Perforation of the uterine wall or cervix
  • Vaginitis

While some medical professionals and consumers may have been made aware of these dangers regarding the Mirena IUD, many women had no prior knowledge of possible health concerns before receiving the device. This was largely due to the fact that the manufacturer, Bayer, ran an advertising campaign for the device. In this campaign, the company focused on “Mirena parties” in which a nurse practitioner and a representative from the website Mom Central would discuss the benefits of Mirena, making the IUD sound much more effective than it really was; additionally, they talked about it in such a way that gave consumers the impression that it provided certain benefits that other IUDs did not. For instance, the ad claimed that the device made the patient “look and feel great,” leading the consumer to believe that the IUD would lead to increased levels of romance, intimacy and, by implication, emotional satisfaction.

The Food and Drug Administration (FDA) gave Bayer a warning regarding this marketing strategy, but it did not stop millions of women from using the product without being fully educated of its potential side effects. Additionally, the FDA faulted the marketing strategy for claiming that the IUD has no routines to comply with, which was ultimately an incorrect statement.
